On June 29, 2006 The California Department of Industrial Relations, Department of  Worker's Compensation  held a hearing  which was purported to a few to be for the public.  The Department actually failed to notify the public about this hearing and was unprepared and surprised when members of the public got wind of it and showed up to make comments.

      Caroline (Carrie)  Nevens who conducted this not advertised public hearing, made the statement to reporters that :

"The DWC announced that it was limiting comments after injured workers -- in the words of acting Administrative Director Carrie Nevans -- "hijacked" a June 29 hearing on proposed utilization-review penalty regulations.."

      How in the world a public servant during a public meeting that does request during the meeting that members of the public wanting to make comments  should sign a form to do so can state that this is considered a "hijacking" is inconceivable.  

      This insulting verbal terminalogy used by government employees to discredit the general population should not be condoned.  We will be presenting in the future actual documents showing some graphic examples of the lack of professionalism and verbal abuse being currently used by  government employees working in this particular agency with the apparent intent to discredit and demean the injured worker.  

     Then  you the public should start thinking about why in the world these people are allowed to continue to hold such well paying positions financed by the citizens of this state.

     The purpose of this hearing was concerning the SB899 Penalty Phase.  The above referenced transcript of this June 29th meeting is page after page after page of the same basic story from members of the public of denial of diagnosis, denial of treatment, denial of medical care in all forms, denial of promised monetary assitance and zero penalties being applied to the wrongdoers.

     It was a denial in general that the California Worker's Compensation System is working at all for the injured employees of this state.  This whole thing is reminiscent of the shameful California Quackenbush Day's.

     These words and actions make it appear as if the Worker's Compensation People either don't have the money stored away to provide the promised care for these people or something not so very nice is going on.  

     All the sympathy in the world voiced by these officials means nothing if they do not start helping the injured employees.

     Serious questions have been raised about the financial stability of this privately financed government agency. The California Department of Audits was requested to examine the workings of SCIF (The State Compensation Insurance Fund).  The Department of Audits, a division of the California Finance Department has been denied access to this government agency's records.  

      How they can get away with this no one seems to know but they have done it and no one is willing to take a stand and stop them in this state's government structure.  I don't know what they have to hide but I do bet it is a real doozy. - Vickie

The Following is a letter to the general public from Dina Padilla:

 To All:
 
      Since this last meeting on 6-29-2006 there have been no investigations, no contacting of injured workers and their advocates concerning their public testimony by the DWC-Director Carrie Nevins who has also stated that injured workers hijacked this public meeting and that she will have a worker comp judge to monitor the next meeting on 8-23-2006 which is about the AECOM guidelines.

      I am asking for a federal investigation and forensic audit which should be conducted immediately by the Dept.of Justice, the Office of Inspector General, the Government Accountability Office and the media.

     That there are criminal acts being commited on injured workers and that the state of California-the Dept. of worker compensation, Dept. of Industrial Relations, the Dept of Insurance, the Fraud Assessment Commission, the California County District attorneys,  many of the legislators and the Governors of this state have not only been complicit with allowing insurance companies and self-insured employers to get away with fraud and murder but are also real actors in authoring and creating legislation to hurt and kill the people of this state. All of these injured workers rights have been violated time after time and nothing has been done on their behalf by the state of California.

      The testimonies of these injured workers, advocates, friends and family are proof that investigations and charges of criminal activity need to be made immediately. That there are other existing testimonies and audio visual tapes to prove that the state of California is allowing fraud and criminal activity to occur with no law and order provided to prevent THE past and present barrage of egregious criminal activity.
